"Can't" always wins over "can" in Magic. The Persecutor says you can't win, so the near-death doesn't let you win.

No, it doesn't. This has nothing to do with layers, or timestamp. This is a simple "can" versus "can't". NDE tells you to win. Persecutor says that you can't. You can't win, therefore you don't.
