    No, cards with flash are not instant spells, only instant spells are instant spells.

    No, it says you can cast it whenever you could cast an instant. That doesn't make it an actual instant.

    Technically yes he did cheat, but chances are he also doesn't know the rule. Although I have no idea how "You may cast this spell any time you could cast an instant." would lead anyone to believe that it's an instant spell.
